By accessing or using PlantFluent (web PWA, Android, or related sites), you agree to these Terms. If you do not agree, do not use the App.

1. What PlantFluent is (and is not)

PlantFluent provides plant identification suggestions, learning/care information, optional market-value context, and an on-device garden journal.

PlantFluent is not:

• A medical device or source of medical, veterinary, or treatment advice
• A foraging, edibility, or toxicity guarantee
• A substitute for professional horticultural, medical, or legal advice

Plant IDs and related content are suggestions only. Always verify before eating, touching, or treating any plant as safe. You use the App at your own risk.

2. Eligibility

You must be able to form a binding contract in your jurisdiction. The App is not directed at children under 13.

3. License to use the App

Subject to these Terms, OfficeGardener grants you a personal, non-exclusive, non-transferable, revocable license to use PlantFluent for your own non-commercial purposes (unless we agree otherwise in writing).

You may not: reverse engineer except where allowed by law; scrape or abuse ID APIs; resell hosted ID credits as a service; circumvent license or credit limits; or use the App for unlawful purposes.

4. Accounts, licenses, and credits

4.1 One-time unlocks (no subscription lead)

PlantFluent’s v1 commerce model is one-time purchases and credit top-ups, not a weekly/annual subscription trap.

4.2 License codes

After a successful Stripe (or store) payment, we email a license code to the address you provide. Redeem in-app (Unlock / License or Settings → License). Licenses are for your personal use; do not share publicly.

4.3 Hosted ID credits

Keep and higher tiers include a finite starter grant of hosted IDs. When credits reach zero, buy credit packs. Credits do not expire while PlantFluent continues to offer hosted ID. Hosted ID is a convenience service; availability depends on our providers and fair-use safeguards.

4.4 BYOK / Sources

You may supply your own API keys where the App supports BYOK. You are responsible for those keys, their billing, and provider terms. We do not guarantee third-party API uptime or accuracy.

4.5 Beta Keep grant

Android closed-test participants who opt in on Google Play and remain opted in for 14 continuous days may receive a free Keep license (~25 hosted IDs). Opting out early or failing to opt in means no grant. Beta Keep is not a paid purchase and is not a refund case.

5. Payments (Stripe and stores)

Web purchases are processed by Stripe. Card data is handled by Stripe; we do not store full card numbers. Store in-app purchases (if offered later) are processed by Apple or Google under their terms.

Prices are in USD unless stated otherwise. Taxes may apply (including Texas sales tax where required).

6. Refunds (14-day)

Paid Keep, Lifetime, Founder Pro, and credit packs (web / Stripe):
Email kyle@brodeur.me within 14 days of purchase for a refund request. Include your purchase email and approximate date.

• Unused or lightly used licenses/credits: we generally provide a full refund via Stripe.
• After heavy hosted-ID consumption, we may offer a partial refund or decline at our reasonable discretion.
• On refund, we may revoke the associated license code and unused credits.

Beta Keep grants: Not purchased — not eligible for a “refund.”

App Store / Play Billing (if used later): Refunds follow Apple / Google policies; contact the store first, and us for license questions.

7. No warranty; limitation of liability

THE APP AND ALL PLANT IDS, CARE TIPS, AND VALUE ESTIMATES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFICEGARDENER AND MISS MISS STUDIOS LLC ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PLANTS, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP OR A PURCHASE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE RELEVANT SKU IN THE 12 MONTHS BEFORE THE CLAIM (OR $12 IF YOU PAID NOTHING).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent allowed.

8. Acceptable use of identification

Do not upload images of people (especially children) or private property you are not allowed to photograph for processing by ID providers. Do not use PlantFluent to harass, spam, or attack systems.

9. Intellectual property

PlantFluent, OfficeGardener branding, and related materials are owned by Miss Miss Studios LLC or its licensors. You retain rights to your journal content and photos you create; you grant us a limited license to process photos solely to provide ID and related features you request.

11. Changes; termination

We may update these Terms by posting a new effective date. Continued use after changes means acceptance. We may suspend or terminate access for abuse, chargebacks, or legal risk. You may stop using the App at any time.

12. Governing law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Exclusive venue for disputes that cannot be resolved informally is the state or federal courts located in Texas, unless applicable consumer law requires otherwise.
